Terms of Service

Effective date: September 18, 2026

After checkout, a licensed dentist in your state reviews your photos. Your impression kit ships only after that review.

An in-person examination with a dentist licensed under chapter 466, Florida Statutes, is recommended before beginning telehealth treatment in order to prevent injury or harm.

Smile Lab USA LLC owns this website and the Smile Lab USA brand. The appliances sold here are made for us by a licensed dental lab. In the clauses below, we and us mean that company. You means anyone who reads the site, writes to us, signs up for our messages or buys something from us. The site, the products, the work on your order and the messages we send are together called the Services.

Using the Services means you take this agreement as it stands. If one part of it does not sit right with you, the answer is straightforward: do not order, and do not use the site.

1. Who can order

1.1 Age

You need to be 18 or older to order from us or to use the Services. If you are acting for somebody else, you need the legal standing to do that. We may ask you to prove your age, including by showing identification, at any point.

1.2 Capacity

Placing an order tells us that you are legally able to enter into a contract, either for yourself or on behalf of the person you represent. That is what makes the rights and the limits written here binding on both sides.

1.3 Under 18

A parent or guardian has to agree on behalf of anyone younger than 18 and has to supervise how the appliance is used. Where that has not happened, we can suspend or close the account without notice.

1.4 Getting the details right

Everything you tell us should be true, complete and current: the delivery address, the payment details, and whatever you send us about your teeth so we can build. Details that are wrong or out of date slow an order down, and they can end it.

1.5 Your account

Keep your sign in details private. Anything done through your account counts as yours, whether or not you meant it to happen. Write to us the moment you suspect somebody else has got in.

2. Agreeing to this page

By carrying on with the Services you confirm that you have read this agreement, followed it, and intend to keep to it. We can revise it, and a revision applies from the moment it appears here. Looking the page over from time to time is on you.

3. Our material

3.1 Ownership

The wording, photographs, film, artwork, logos, page layouts and code you find here belong to Smile Lab USA LLC, to companies in its group, or to the people who granted us the right to use them. Copyright, trademark and related law protects all of it, inside the United States and beyond it.

3.2 What you may do with it

We give you a narrow permission to open the site and use what is on it for your own private purposes. That permission is not exclusive and we can pull it back. It does not stretch to reproducing the material, passing it around, or earning money from it.

3.3 What is not allowed

  • You may not reproduce, alter, republish or build something new out of our material unless we have agreed in writing
  • You may not put our material to work in advertising, promotion or any other trading activity
  • You may not take apart, decompile or interfere with the site or the Services

3.4 Anything you send us

Suggestions, notes and ideas about the Services become ours once you send them. You transfer every right in them to Smile Lab USA LLC, and we owe you nothing in return, neither a fee nor a credit.

4. Personal use only

4.1 What this is for

Everything we build belongs to the person who ordered it, and the site is here for private use.

4.2 No commercial use

  • Do not resell what we make, hand it around, or advertise it for money
  • Do not fold the Services or the products into a business or a service you offer to other people
  • Do not use them in a giveaway or a promotional campaign unless we have said yes first

4.3 Enforcement

Where we see trading activity we never agreed to, access can be suspended or closed.

5. Orders, payment and prices

5.1 When an order becomes an order

What you place is an offer until we take it. We can turn one down or cancel it, for instance when an item is not available, when a price printed wrongly, or when a payment looks fraudulent.

5.2 Money

We quote and charge in United States dollars. The full amount is taken before your case goes to the bench. Prices here can move at any time, and a move never reaches backwards into an order we have already confirmed.

5.3 How you can pay

Checkout runs on Stripe. Credit cards, debit cards, Apple Pay, and Klarna or Afterpay on orders whose value qualifies. HSA and FSA cards are accepted, one card for each order, with no splitting a single order across two cards. Whether a given item qualifies is settled by your plan administrator and not by us.

5.4 Tax

Sales tax, duties, customs charges and comparable fees raised on your order are yours to pay.

6. Refunds and returns

The Refund Policy is the full document. This clause gives you its shape. Where the two read differently, the Refund Policy is the one that governs.

6.1 What a refund covers

Before the impression kit ships, you can have your money back in full. After the kit has shipped and before the bench work starts, everything but the kit fee in 6.2 comes back. Once we have started building, money back is limited to a manufacturing fault we have confirmed, meaning the appliance does not match what we set out to make because of our workmanship or our materials. Changing your mind about how it looks is not a fault: tooth shape, gum shade, style and a shade you picked yourself are your decisions and they do not open a refund after the build begins. Anything sent back has to reach us clean, unaltered and in the condition it left in. Signs of wear, of tinkering, or of damage from rough handling end eligibility. Requests are accepted for 60 days counted from the day the appliance was delivered.

6.2 The impression kit

The kit fee of $49.99 stays with us whether or not the box was opened. Impression material that has been inside somebody's home cannot come back into a laboratory. That is a hygiene line, it protects you and it protects the people who work here, and we do not cross it.

6.3 Say what you want before we start

Preferences about the look, the size, the shape or the style of your appliance have to reach us before the build begins. From the moment a case is on the bench, the design is settled by the lab's technicians working from what you told us, from your own anatomy and from what the material will allow. Nothing can be changed after that point.

6.4 Rush fees and accessories

Rush manufacturing is not refundable once building has started, because the slot in the queue, the labour and the materials are committed the moment you buy it. Rush shipping is not refundable once the box is moving, because the carrier bills us for that service up front. If we miss a rush date for a reason of our own, the rush fee comes back to you. Accessories follow their own rule, which is set out in the Refund Policy.

6.5 How to start one

Write to info@smilelabusa.com and send three things: your order number, photographs that show what has gone wrong, and a description of the problem in your own words. We read it and tell you whether the appliance needs to come back. Once it is here and the fault is confirmed, the money returns to the card you paid with. The Refund Policy states how quickly we pay.

6.6 Exceptions

  • No refund where an appliance has been altered, adjusted or repaired by anybody other than the lab that built it
  • No refund for loss, theft or damage after the box has left us, subject to clause 7, which sets the seven day window for a carrier claim and leaves your delay rights untouched
  • No refund where the problem came from misuse, from poor care, from ignoring the instructions we send, or from a change of taste about the design after the build began

7. Shipping

The Shipping Policy is the full document. This clause gives you its shape, and the Shipping Policy governs where the two differ.

7.1 Carriers

Packages travel with USPS, UPS, FedEx and DHL. Labels and tracking are produced through Shippo. Which carrier gets your box depends on where it is going and what is in it, and because their services differ, transit times differ too.

7.2 Dates

Transit dates quoted at checkout or in a confirmation are estimates of what a carrier will do. Weather, a backlog at a sorting hub, a misroute or a customs queue can move them, and those things sit with the carrier rather than with us. We will open a trace whenever a package stops moving. What does not sit with the carrier is the ship date we promised you before you paid. Nothing written on this page removes your right to cancel for a refund in full if we miss the ship date we promised, at whatever stage your order has reached. We write to you before that date passes, we tell you the new one, and you decide. That right comes from the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule, 16 CFR Part 435, and the Refund Policy and the Shipping Policy set out how it works in practice.

7.3 Tracking and packages that do not arrive

A tracking number reaches you by email as soon as the package has one, and the same number sits on your order status page. Please watch it, and please make sure somebody can take the delivery. If tracking stalls, or the box misses the date the carrier gave, email us within seven days of that date. Inside that window we can still file a claim and get a replacement moving. Outside it the carrier stops accepting claims and our hands are tied. An address entered incorrectly at checkout is not something we can cover, though we will always help you chase the package.

7.4 Changing an address

Tell us as early as you can. Before a label is printed we can usually redirect an order on one email. After it is printed the carrier decides, and sending a second package costs whatever a second package costs.

7.5 Orders leaving the United States

Import duty, tax and customs handling on an international order belong to the buyer. We cannot promise how long a customs queue will take and we cannot absorb those charges.

7.6 Damage

Open the box and look at what is inside. If something arrived broken, photograph the outer packaging and the contents and email both sets of pictures to us within seven days. Carriers want to see the packaging as much as the item, so please send both.

8. Warranty

8.1 What is covered

Every appliance we build carries a 60 day manufacturer warranty running from the day it is delivered. Inside that period, adjustments to the fit are unlimited and free for the first 30 days after delivery, and so is a remake for fit. A remake for a manufacturing fault we have confirmed is covered for the whole 60 days. If the same problem comes back, a technician reads the case by hand before we build again.

8.2 Not covered

  • An appliance that has been lost or stolen, or damaged by accident, by misuse or by neglect
  • Your own mouth changing after we built it, an extraction or other dental work included, and a shade, a size or a design the customer selected
  • Adjustments or repairs carried out by anybody other than the lab that built it

8.3 Safety and cover

Take the appliance out and contact us if it feels too tight, too loose, or uncomfortable. What we make is cosmetic and it replaces nothing that a dental professional does. Wearing something that hurts, or using it for a purpose it was not built for, can end your cover.

8.4 Making a claim

Write to info@smilelabusa.com, quote the order, and attach photographs where you have them. We may ask for the appliance back so we can examine it. Adjustments and remakes under this warranty cost you nothing, with the impression kit fee still standing outside it.

8.5 Who decides

The lab's technicians assess every warranty claim and decide whether what you have is a manufacturing fault. Where it is one, we arrange the adjustment or the remake straight away.

8.6 Limits

This warranty belongs to the person who bought the appliance and cannot be handed to anybody else. It does not reach harm caused by an accident, by misuse, or by a health problem unconnected to how the appliance was made.

9. Design and the build

9.1 Who settles the design

A licensed dentist in your state reviews your photos and approves the appliance before it is made. Comfort, fit and function then turn on judgements made at the bench.

9.2 Your preferences

Send us what you want for tooth shape, gum shade and style before the build starts. Anything arriving after that cannot be worked in.

9.3 Adjustments

A small adjustment once you have the appliance in your hands is ordinary rather than a fault. We talk you through it, and where a change is needed we make it under the warranty terms above.

10. Changes to this page

We can revise, add to or rewrite this agreement and the policies it points at. A change is live from the moment it is posted, and continuing to use the Services after that is how you accept the version you find here.

10.1 Being told. We may send an email or put a notice on the site when something material changes. We do not promise to, so please read the page yourself now and then.

10.2 Messages from us. Using the Services means we may write to you about your order, about changes to this agreement, and about what we sell. Your account settings control what marketing you receive, and the text message rules in clause 14 apply to anything sent to your phone.

11. What we need from you

  • Keep your contact details and your delivery address accurate and current
  • Follow the care sheet we send, and wear the appliance the way it was built to be worn
  • Tell us quickly when something looks wrong, so we can examine it while the warranty still runs
  • Attend the dental visits you are due, and the one clause 12.5 requires within a month of delivery

12. Disclaimers and the limit on liability

12.1 Cosmetic products

What we build is cosmetic. It fills a gap and it changes how a smile looks. It is not a stand in for care from a dental professional and it does not do what treatment does.

12.2 We give no medical advice

We are an appliance brand, not a dental practice. We hold no dental licence in Florida or in any other state, we diagnose nothing, and we treat nothing. Each appliance is built to order by a licensed dental lab from the impressions you post to us. Anything touching on your oral health belongs with your own dentist.

12.3 At your own risk

Using the site, the impression kit and the appliance is something you do at your own risk. Stop wearing the appliance and contact us if it hurts, if the tissue around it is irritated, or if anything about your mouth changes.

12.4 Limitation of liability

So far as the law allows, our liability does not reach:
  • loss that is direct, indirect, incidental or consequential
  • lost earnings, distress, or damage to property
  • medical complications or health problems that did not come from a fault in how the appliance was made

12.5 Seeing a dentist

A licensed dentist in your state reviews your photos and approves the appliance before it is made. You are also required to visit a licensed dentist within one month of receiving your appliance, so that somebody qualified confirms your oral health and confirms that what we built suits your mouth. Where the appliance is uncomfortable, loose or tight before that month is out, stop wearing it and see a dentist sooner.

13. Safety and health warnings

13.1 Dental consultation

Talk to a dentist first if any of this describes you, before you take an impression and before you wear anything we make.
  • A tooth that moves, or a filling or crown that is not solid
  • Pain in the jaw
  • Decay that has not been treated, or sores anywhere in the mouth

13.2 When to stop

Take the appliance out and stop wearing it if you notice any of the following.
  • Discomfort of any kind
  • Irritation of the gum or the cheek, or bleeding
  • A bite that feels different, or a fit that has shifted

13.3 Small parts

There are small parts in what we send you. Keep the box and everything in it out of reach of children under three.

13.4 Check it over

Look the appliance over regularly. If any part of it is cracked, missing or loose, leave it out and contact us.

14. Text messages

14.1 What you are agreeing to

Opting in to text messages means you agree to receive both service messages about your order and marketing messages from us, sent through Twilio to the number you gave us.

14.2 It is optional

Saying yes to texts is never a condition of buying anything from us. Whatever your mobile plan charges for messages and data still applies, and how often we write varies.

14.3 Getting out

Reply with the word STOP and the messages end. Every message also carries the opt out instructions, and replying HELP reaches support.

14.4 Delivery

A mobile network answers neither to you nor to us for a message that turns up late or that never turns up at all.

15. Governing law

Florida law governs this agreement, and conflict of law rules do not move that. Court proceedings belong in the state or federal courts serving Broward County, Florida.

16. Arbitration

Disputes between us are settled by binding arbitration under the Federal Arbitration Act, and not by a judge. The hearing sits in Broward County, Florida, unless the two of us agree on somewhere else. You give up the right to a jury, and you give up the right to join a class action or any other collective proceeding.

17. Insurance

We are not in network with any insurer and we do not bill one. If a receipt or a document helps your case, ask and we will send what we hold, as a courtesy and nothing more. Filing the claim and arguing it out are between you and your insurer. HSA and FSA cards we do take, and your plan administrator has the final word on whether a particular item qualifies.

18. Things you agree not to do

  • Disrupt the site or the Services, or get in the way of somebody else using them
  • Take apart or tamper with an appliance, with the site, or with anything we publish
  • Use the Services for fraud or for any other unlawful purpose

19. If one clause fails

Should a court find that one part of this agreement cannot stand, that part drops out and everything else carries on working exactly as written.

20. Photographs of your teeth

Usable photographs of your teeth have to reach us before we can work on your case. They need to be sharp, well lit, in focus, and they need to show the whole smile and the full gum line. Where those photographs do not arrive, the case is marked not in compliance, and we hold the work until they do. If what you send cannot be used, we will ask you for a fresh set.

21. What you confirm when you order

Placing an order is how you confirm each of the following.
  • What we build changes how a smile looks and treats nothing. Where your needs run past appearance, an appliance from us is not the right answer and you are not a suitable candidate for one
  • Our materials are chosen for safety and infrequent side effects are still possible. The usual ones are soreness or sensitivity in a tooth or a gum, and irritation of the soft tissue
  • You will take the appliance out and speak to your dentist or your doctor if any of those appear
  • Any allergy or chemical sensitivity you know about reaches us before you order, not after

22. Indemnity

You cover us to the fullest extent against every liability, cost, demand, cause of action, damage and expense, reasonable legal fees included, that arises out of your breach of any part of this agreement.

23. Assignment

We may assign, transfer or subcontract our rights and our obligations under this agreement, without notice to you and without your consent. You may not assign, transfer or subcontract yours.

24. The website itself

The site is provided as it stands, with all faults. We make no representation and give no warranty of any kind about the site or about the material published on it, and nothing you read here is consultation or advice. The warranty in clause 8 covers the appliance we build for you and stands entirely apart from this clause.

25. The whole agreement

This page, together with the policies it points at, is the entire understanding between you and us about your dealings with Smile Lab USA. It replaces every earlier statement or representation, written, spoken or otherwise.
